These Terms of Service ("Terms") govern your use of Fake Finder, including our website at fakefinder.app and our mobile apps (together, the "Service"), operated by Fake Finder Ltd ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Important: Fake Finder uses artificial intelligence to assess content. It can make mistakes and its results are not guaranteed to be accurate. Fake Finder is a guide only — it is not a substitute for your own judgement and due diligence, and it is not legal, financial, or professional advice.

1. What Fake Finder Does

Fake Finder uses AI and automated analysis to give you an indicative assessment of whether content (such as an email, link, message, photo, video, or headline) may be genuine, misleading, or fake, along with supporting reasoning and sources where available. These assessments are probabilistic opinions generated by software, not statements of fact.

2. No Guarantee of Accuracy

AI systems can and do produce errors, including false positives (flagging genuine content as fake) and false negatives (failing to flag fake content). We make no representation, warranty, or guarantee that any result is accurate, complete, reliable, current, or fit for any particular purpose. Results may change over time and may differ between checks of the same content.

3. Your Responsibility — Do Your Own Due Diligence

You are solely responsible for any decision you make or action you take. You must use your own judgement and carry out your own independent due diligence before relying on, acting on, or sharing anything related to a Fake Finder result. Do not use the Service as your sole basis for any financial, legal, safety, employment, reputational, medical, or other important decision. Where a matter is important, consult an appropriately qualified professional.

4. Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including (to the maximum extent permitted by law) implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

5. Limitation of Liability

To the maximum extent permitted by law, Fake Finder Ltd, its directors, employees, and suppliers will not be liable for any loss or damage — including any direct, indirect, incidental, consequential, special, or punitive loss, or any loss of profits, data, goodwill, or reputation — arising out of or in connection with your use of, or reliance on, the Service or any result it produces, even if we have been advised of the possibility of such loss. You agree that you use the Service entirely at your own risk. Where liability cannot lawfully be excluded, our total aggregate liability is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits any rights you have under mandatory consumer laws (such as the New Zealand Consumer Guarantees Act, where it applies) that cannot lawfully be excluded.

6. Acceptable Use & Use of Results

You agree not to use the Service to break the law, infringe others' rights, attempt to disrupt or reverse-engineer the Service, or rely on it in a way that could harm yourself or others.

How you may use results: A Fake Finder result is an indicative, AI-generated opinion for your own personal use. You agree not to present a result as a statement of fact, and not to publish, broadcast, or share a result in a way that could defame, harass, accuse, or harm any person or organisation. Any decision to act on, share, or rely on a result is yours alone, and you are responsible for the consequences.

7. Your Content & Intellectual Property

You keep ownership of the content you submit. By submitting content you confirm you have the right to do so, and you grant us a limited, temporary licence to process it solely to provide the analysis. We do not sell your content, and submitted content is automatically deleted after a short period (see our Privacy Policy). Do not submit content you have no right to share, or that is unlawful. If you believe content processed by the Service infringes your rights, contact us via the Contact page and we will respond.

8. Accounts & Eligibility

You must be 18 years or older to use Fake Finder. You are responsible for keeping your account credentials secure and for activity under your account.

9. Subscriptions, Trial & Cancellation

Fake Finder offers a free trial followed by a paid subscription that renews automatically until cancelled. The price, billing frequency, and trial length are shown clearly before you subscribe, and you must affirmatively agree to them. You can cancel at any time: on the website through your Account page, and for in-app purchases through your Apple App Store or Google Play account. Cancellation stops future charges and takes effect at the end of the current billing period. Payments made through the App Store or Google Play are also governed by those stores' terms.

10. Changes to the Service or Terms

We may update the Service or these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction, without affecting any mandatory consumer rights in your country of residence.
